These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("User", "you", or "your") and Guardian Assist Pty Ltd (ABN 74 673 724 537) ("Guardian Assist", "we", "us", or "our") governing your use of our mobile applications, web portal, GPS tracking devices, and emergency response services (collectively, the "Services").
By creating an account, purchasing a subscription, or using any of our Services, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must not use our Services.
We reserve the right to modify these Terms at any time. We will notify you of material changes via email or through the app. Your continued use of the Services after such notification constitutes acceptance of the modified Terms.
You must be at least 18 years of age to create an account and enter into these Terms. The Services are not intended for use by individuals under the age of 13. If you are between 13 and 17 years of age, your parent or legal guardian must create the account on your behalf, accept these Terms, and supervise your use of the Services.
If you add a family member under the age of 18 to your Guardian Assist family group, you represent and warrant that you are their parent or legal guardian (or have obtained consent from their parent or legal guardian) and that you consent to the collection, use, and sharing of their personal information — including real-time location data — in accordance with these Terms and our Privacy Policy. You are responsible for monitoring and managing the minor's use of the Services.
Guardian Assist provides personal safety and vehicle protection services. The specific features available to you depend on your membership plan (see Section 3). Our Services include:
Our mobile application provides GPS location tracking, SOS emergency alerts, family location sharing, live location link sharing, Ghost Mode, geofence notifications, and location history. The app is available for iOS and Android devices. Some features require an active paid subscription.
We offer a GPS tracking device (the TR22 Pro) for vehicle monitoring. This device provides real-time location updates, movement alerts, and integration with our response system. Device functionality requires an active subscription.
Our emergency monitoring is provided by a licensed, Grade A1 certified security control room that operates 24 hours a day, 7 days a week, 365 days a year. Trained operators monitor emergency alerts and coordinate responses, including security dispatch, police notification, and ambulance services as appropriate. Control room monitoring is a paid-plan feature and is only available while your paid subscription is active. The Free plan does not include control room monitoring — see Sections 3 and 8.
The app lets you share your location with members of your family group, create time-limited live location links, and pause location sharing using Ghost Mode. These features are described in Section 6 and must only be used for lawful, private, and consensual purposes.
Compatible Apple Watch devices can connect to our system to trigger SOS alerts directly from the wrist. Support for Garmin smartwatches is in development and will be offered as a "coming soon" feature; until released, it is provided (if at all) on the basis set out in Section 11.4.
We offer a Free plan and several paid plans (currently Individual, Family, Family Plus, and Vehicle Protection). The exact features, member limits, location-history periods, and pricing for each plan are shown on our website and at the time of purchase, and may change from time to time in accordance with Section 4.3. The most important difference between the plans is whether they include monitoring by our control room.
The Free plan lets you share your location within your family group and use the SOS button. When you press SOS on the Free plan, the app sends an alert by SMS and push notification to the emergency contacts you have nominated. It does not reach our control room, and no operator is monitoring or dispatching a response on your behalf. Your nominated contacts are responsible for deciding how to respond, including calling 000. The Free plan also has reduced location history and member limits compared with the paid plans.
Important: The Free plan is not a monitored emergency service. No person is watching for your alerts. If you want your SOS alerts to reach our 24/7 control room, you need an active paid plan. In any life-threatening emergency, always call 000.
Paid plans include monitoring by our licensed, Grade A1 certified control room while your subscription is active. When you press SOS on an active paid plan, your alert is received by the control room, who will attempt to verify the situation and coordinate an appropriate response, as described in Section 8.
Control room monitoring and other paid features are only available while your paid subscription is active and paid up to date. If your subscription lapses, is suspended, or is cancelled, you lose access to control room monitoring and your account behaves like a Free plan (contacts-only alerts). See Section 4.6.
The plans we offer, and the features and limits of each, are described in Section 3 and on our website. The Free plan provides limited functionality at no cost. Paid plans are billed as set out below.
Subscription fees are billed in advance on a monthly or annual basis, depending on your chosen billing cycle. Paid plans have a 12-month minimum term and then continue month-to-month unless cancelled. Your subscription will automatically renew at the end of each billing period at the then-current rate unless you cancel before the renewal date. Payment is processed through Stripe using the payment method you provide. You authorise us to charge your payment method for all fees due, including recurring renewal charges.
We reserve the right to change subscription prices with at least 30 days' notice. Price changes will not affect your current billing period but will apply to subsequent renewals.
If a payment fails, we will attempt to process the charge again. After multiple failed attempts, your subscription may be suspended or cancelled. You remain responsible for any uncollected amounts.
Subscription fees are non-refundable except as required by Australian Consumer Law. GPS device purchases come with a 30-day money-back guarantee — see Section 5.2.
If your paid subscription becomes past due, is suspended, or is cancelled, control room monitoring stops and your account reverts to Free-plan behaviour — your SOS alerts will go only to your nominated emergency contacts, not to our control room. We will attempt to notify you of a failed or overdue payment, but you should not rely on control room monitoring while any payment is outstanding. To restore monitoring, bring your subscription up to date.
Consumer Guarantee: Nothing in these Terms excludes, restricts, or modifies any rights you may have under the Australian Consumer Law that cannot be excluded, restricted, or modified by agreement.
GPS tracking devices remain your property after purchase. However, the device requires an active subscription to function, as it relies on our SIM card, data plan, and backend infrastructure.
We offer a voluntary 30-day money-back guarantee on GPS hardware. If you are not satisfied, you may return the device within 30 days of delivery, in its original condition and packaging, for a refund of the device purchase price. Subscription fees for any period during which the service was available to you are not refundable under this guarantee. This guarantee is in addition to, and does not limit, your rights under the Australian Consumer Law.
To start a return, contact us at support@guardianassist.com.au for a return authorisation. You are responsible for return postage and for ensuring the device reaches us safely; we recommend a tracked service. Once we receive and inspect the device, we will process any eligible refund to your original payment method. Refunds required by the Australian Consumer Law (for example, where goods are faulty) are not affected by this process and may include reimbursement of postage.
The TR22 Pro is a hardwired device. You may install it yourself or have it installed by a qualified third party (such as an auto electrician). If you choose self-installation, you do so at your own risk and are responsible for installing the device correctly, safely, and in compliance with all applicable laws. We are not liable for damage caused by improper installation. Where a third party installs your device, that installer is engaged by you, not by us, and we are not responsible for their work, conduct, or any damage they cause. We recommend professional installation for hardwired devices.
Fitting an aftermarket device to your vehicle — particularly a hardwired device — may affect or void your vehicle manufacturer's warranty, and may not be permitted under the terms of some leases, insurance policies, or finance agreements. It is your responsibility to check these before installation. You accept this risk, and to the maximum extent permitted by law we are not liable for any loss of vehicle warranty, or for any damage to your vehicle, arising from the installation, presence, use, or removal of a device.
GPS devices are covered by a lifetime warranty for as long as your subscription remains active. This warranty covers manufacturing defects and hardware failures under normal use. It does not cover:
This warranty is in addition to any guarantees you have under the Australian Consumer Law, which cannot be excluded.
Each GPS device includes a pre-installed SIM card and unlimited data as part of your subscription. The SIM card remains our property. Attempting to remove, replace, or modify the SIM card may damage the device and void your warranty.
The app lets members of your family group see each other's location, as configured by the group. Each member's participation is governed by these Terms and our Privacy Policy.
You can create a time-limited link that shares your live location (or the location of a vehicle or device you own) with someone you choose. These links expire automatically after the period you select and can be revoked by you at any time. A person who opens the link sees limited information only — a first and last name and the current location — and not your contact details, history, or other personal information.
Location sharing and live links are provided for private, personal, and consensual use only. You must only share your own location, or the location of a person you are lawfully responsible for (such as your own child) or who has agreed to be shared. You are responsible for obtaining a person's consent before sharing or tracking their location, and you must not use the Services to monitor, track, follow, or locate any person without their knowledge and consent. Using the Services to stalk, harass, intimidate, or harm any person is strictly prohibited and may result in immediate suspension of your account.
Ghost Mode lets you pause location capture and sharing for a period you choose. While Ghost Mode is active, your location is not recorded or shared with your family group. For your safety, triggering an SOS automatically turns Ghost Mode off and reveals your live location to your emergency contacts and (on an active paid plan) our control room. This safety override cannot be disabled.
If you believe someone is sharing or tracking your location without your consent, or is otherwise misusing the Services, contact us immediately at privacy@guardianassist.com.au. We will investigate and may revoke links and suspend accounts.
You are responsible for maintaining the confidentiality of your account credentials. You must notify us immediately if you become aware of any unauthorised use of your account.
You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate.
You agree to use our Services only for lawful purposes. You must not use our Services to:
You are responsible for keeping your emergency contact information current. We are not liable for delays or failures in contacting outdated emergency contacts.
For our Services to work effectively, you must enable "Always" location permission on your device. By enabling location services and using the app, you expressly consent to the continuous collection, processing, and sharing of your real-time location data with members of your Guardian Assist family group and, during emergency events, with our control room and emergency services. If you disable location tracking, our ability to assist you in an emergency will be compromised and certain features will not function.
By creating an account, you consent to receive electronic communications from us, including email notifications, push notifications, SMS messages (including emergency SOS alerts), and in-app alerts. These communications may include emergency alerts, service updates, billing notices, and promotional information. You may opt out of promotional communications at any time, but you cannot opt out of essential service and security communications while your account is active.
Free plan: Pressing SOS sends an alert by SMS and push notification to your nominated emergency contacts. There is no control room and no operator monitoring or dispatching on your behalf.
Active paid plan: Pressing SOS sends your alert to our licensed, Grade A1 certified control room, which operates 24 hours a day, 7 days a week. Operators will:
If your paid plan is not active (for example, a payment is overdue), your account behaves like a Free plan and your SOS alerts go only to your contacts — see Sections 3.4 and 4.6.
Our control room service is provided on a best-effort basis. We do not promise or guarantee any particular response time. Response times depend on many factors outside our control, including your location, network conditions, and the availability and capacity of emergency and security services.
Our Services depend on GPS signal, cellular network coverage, device battery, third-party networks, and software, all of which can fail or be delayed. The Services:
You must not rely on the app, a device, or the control room as your only means of summoning help.
If you need help and are not sure your alert was received — do not wait. For any life-threatening emergency, call 000 immediately; 000 is always your primary emergency service. If you press SOS and do not get a response, or you cannot use the app, you can also reach our control room directly, 24 hours a day, on 1300 308 114. Never rely on the app or your device alone as your only way to call for help.
Guardian Assist supplements but does not replace the emergency services (000). In any life-threatening situation, you should call 000 directly. Our Services are designed to complement, not replace, traditional emergency response.
Repeated false or accidental SOS alerts may result in reduced response priority or service suspension. You may be held liable for costs incurred from repeated false alerts that result in emergency service dispatch.
We collect and process personal information including location data, account information, and usage data. Our full Privacy Policy is available at guardianassist.com.au/privacy-policy and forms part of these Terms.
While Ghost Mode is active, your location is not captured, so no location data is generated for that period — except where you trigger an SOS, which overrides Ghost Mode as described in Section 6.4.
All data is stored on secure servers located in Australia. We comply with the Australian Privacy Principles and the Privacy Act 1988 (Cth).
We may share your location data with:
Location history is retained according to your subscription plan. We retain account information for as long as your account is active and for a reasonable period thereafter for legal and business purposes.
You may request the deletion of your account and associated personal data by contacting us at privacy@guardianassist.com.au or through your account settings. Upon receiving a verified deletion request, we will delete or de-identify your personal information within 30 days, except where we are required to retain certain data by law or for legitimate business purposes such as fraud prevention or resolving disputes. Deletion of your account will result in permanent loss of access to the Services, location history, and all associated data.
The Services, including all content, features, functionality, software, designs, text, graphics, logos, trademarks, and documentation, are owned by Guardian Assist Pty Ltd or our licensors and are protected by Australian and international copyright, trademark, patent, and other intellectual property laws. Nothing in these Terms grants you any right, title, or interest in our intellectual property except for the limited right to use the Services in accordance with these Terms.
We grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the Services for your personal, non-commercial use in accordance with these Terms. This licence terminates automatically if you breach any provision of these Terms.
If you provide us with feedback, suggestions, or ideas regarding the Services ("Feedback"), you assign to us all rights in the Feedback and agree that we may use, modify, and incorporate such Feedback into our Services without restriction, attribution, or compensation to you.
To the maximum extent permitted by law, the Services are provided on an "as is" and "as available" basis without warranties of any kind, whether express, implied, or statutory, including but not limited to implied warranties of merchantability, fitness for a particular purpose, accuracy, reliability, and non-infringement.
We do not warrant that the Services will be uninterrupted, error-free, secure, or available at any particular time or location. We do not warrant the accuracy or completeness of any location data, map data, or other information provided through the Services. GPS and cellular technology have inherent limitations that may affect accuracy and availability.
The Services may integrate with or rely upon third-party services including payment processors, mapping services, telecommunications providers, and emergency services. We do not warrant, endorse, or assume responsibility for any third-party services, and we are not liable for any loss or damage caused by your reliance on or interaction with third-party services.
We may offer features designated as "beta", "preview", "coming soon", or "early access". These features are provided for evaluation purposes, may contain errors, and may be modified or discontinued at any time without notice. Beta features are provided without any warranty and your use of them is at your own risk.
Consumer Guarantee: Nothing in this section excludes, restricts, or modifies any consumer guarantee under the Australian Consumer Law that cannot be excluded, restricted, or modified by agreement.

To the maximum extent permitted by law, our total liability to you for any claims arising from or related to the Services is limited to the amount you paid us in subscription fees in the 12 months preceding the claim.
To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill.
Nothing in these Terms excludes or limits any guarantee, condition, warranty, right, or remedy implied or imposed by the Australian Consumer Law or any other legislation that cannot be lawfully excluded or limited.
You agree to indemnify, defend, and hold harmless Guardian Assist Pty Ltd, its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable legal fees) arising out of or related to: (a) your use of or access to the Services; (b) your breach of these Terms; (c) your violation of any applicable law or regulation; (d) your violation of any third party's rights, including privacy rights; or (e) any claim that your use of the Services caused damage to a third party.
We are not liable for any failure or delay in performing our obligations where such failure or delay results from events beyond our reasonable control, including but not limited to natural disasters, acts of government, telecommunications or power failures, equipment malfunctions, cyber attacks, pandemics, or any other force majeure event. During such events, our obligations are suspended for the duration of the disruption.
You may cancel your subscription at any time through your account settings or by contacting support. Cancellation takes effect at the end of your current billing period. No refunds are provided for partial billing periods.
We may suspend or terminate your account immediately if you:
Upon termination, your access to the Services will cease. GPS devices will stop functioning. You remain responsible for any outstanding fees. We may retain your data as required by law or for legitimate business purposes.
These Terms are governed by the laws of New South Wales, Australia. You agree to submit to the non-exclusive jurisdiction of the courts of New South Wales.
These Terms, together with our Privacy Policy and any other policies referenced herein, constitute the entire agreement between you and Guardian Assist regarding the Services.
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
Our failure to enforce any provision of these Terms does not constitute a waiver of that provision or any other provision.
You may not assign or transfer your rights under these Terms without our written consent. We may assign our rights and obligations to a successor entity in the event of a merger, acquisition, or sale of assets.
If a dispute arises between you and Guardian Assist, we encourage you to first contact us at legal@guardianassist.com.au to seek an informal resolution. If the dispute cannot be resolved informally within 30 days, either party may refer the matter to mediation administered by the Australian Disputes Centre (ADC) in Sydney, New South Wales. If mediation is unsuccessful, either party may commence legal proceedings in the courts of New South Wales, Australia.
