We use your information to:
We collect and process your personal information under the following grounds, in accordance with the Australian Privacy Principles (APPs):
Our Services use automated processing to deliver safety features including geofence breach notifications, speed alerts, SOS alert triggering, and emergency response coordination. These automated processes are integral to the real-time nature of our safety services. Our 24/7 Security Control Room operators apply human judgement when responding to emergency alerts and coordinating with emergency services.
Location data is central to our service. We want you to understand how it works:
Location data is collected continuously while the app is active or GPS devices are connected. TR22 Pro devices transmit location data every 10 seconds when the vehicle is in motion.
Location history is retained for the duration specified by your subscription plan (24 hours for Free, 7 days for Individual and Family, 30 days for Family Plus). After this period, location data is automatically deleted.
Only account holders and authorised family group members can view location data. Our Security Control Room operators access location data only when responding to active emergency alerts.
When you join or create a Guardian Assist family group, you consent to sharing your real-time location with other members of that group. Each family member must independently consent to location sharing by creating an account and enabling location permissions on their device. For children under 18, parental consent is required (see Section 10). Any family member can pause or disable their own location sharing at any time through the app. The family group administrator can manage member access and remove members from the group.
Ghost Mode lets you pause location capture and sharing for a period you choose. While Ghost Mode is active, your location is not captured, so no location data is generated for that period — there is nothing for us to store or share. For your safety, triggering an SOS automatically turns Ghost Mode off and reveals your live location to your emergency contacts and (on an active paid plan) our control room. This safety override cannot be disabled.
You can create a time-limited link that shares your live location (or the location of a vehicle or device you own) with a person you choose. These links expire automatically after the period you select and can be revoked by you at any time. A person who opens the link sees only a name and the current location — not your contact details, location history, or other personal information. You must only share links for private, consensual purposes and must not use them to track or monitor anyone without their knowledge and consent. If you believe a link is being used to track you without consent, contact us at privacy@guardianassist.com.au and we will investigate.
We do not sell location data to any third party. Location data may be shared with emergency services during an active emergency response, or as required by law.
Important: We do not sell, rent, or trade your location data to any third party for any purpose. Location data is used solely to provide our safety and tracking services.
We may share your information with:
Police, ambulance, and fire services when responding to panic alerts or safety emergencies.
Our ASIAL-certified security operators who monitor and respond to emergency alerts 24/7.
Stripe processes all payment transactions. Stripe's privacy policy applies to payment data they handle.
Cloud hosting (AWS Sydney region), email delivery, SMS providers, and mapping services that help us operate our platform. All providers are bound by data protection agreements.
When required by Australian law, court order, or government authority.
We use ClickSend to deliver SMS messages including emergency SOS alerts, family invite links, and service notifications. ClickSend processes recipient phone numbers and message content on our behalf and is bound by a data processing agreement.
In the event of a merger, acquisition, or sale of assets, your information may be transferred as part of the business.
While your primary data is stored in Australian data centres, some of our service providers may process data in other countries. Stripe (payment processing) operates in the United States, and Google (mapping and analytics services) may process data internationally. In accordance with Australian Privacy Principle 8, we take reasonable steps to ensure overseas recipients handle your information consistently with the APPs, including through contractual arrangements and selecting providers with robust data protection practices.
Our website and app may contain links to third-party websites or services that are not operated by us. We are not responsible for the privacy practices of those third parties. We encourage you to review their privacy policies before providing any personal information.
No Data Sales: We do not sell, rent, or trade your personal information to third parties for marketing purposes.
We implement industry-standard security measures including:
